I. General information

(„ByChoice") is responsible for protecting your personal data. This document informs you about the processing of your personal data when using the website bychoice.ro.

II. Categories of personal data processed

II.1. If you are a customer of bychoice.ro, ByChoice will process your personal data, such as your full name, phone number, email address, billing and delivery addresses, information about how you use bychoice.ro, and any other data you provide directly when creating a user account, placing an order through bychoice.ro or otherwise arising from the use of bychoice.ro.

If, to create your user account on bychoice.ro, you use your Facebook or Google account, ByChoice will process the following public profile data displayed by those applications: username and email address.

If you choose to create a user account only before completing an order for a product available on bychoice.ro, your email address will be requested and used to create an account automatically. If you do not complete the order, your email and other details will not be stored by ByChoice, and the account created will be deleted automatically.

II.2. If you are a visitor to bychoice.ro, ByChoice will process the personal data you provide directly when using bychoice.ro, such as details entered in the questions or complaints form, if you complete it.

II.3. If you are a contact person for Partners or potential Partners, ByChoice processes contact details such as your full name, email and phone number that you provide when initiating or performing a contractual relationship with Partners or potential Partners.

III. Purposes and legal bases for processing

III.1. If you are a customer of bychoice.ro, ByChoice processes your personal data as follows:

• to perform the contractual relationship between you and bychoice.ro, including receiving, validating, dispatching and invoicing orders placed on bychoice.ro, informing you of order status, arranging returns of ordered products, etc.
• to fulfil the legal obligations of ByChoice in connection with services provided through bychoice.ro, including tax and archiving obligations.
• to communicate commercial materials, newsletters and/or alerts containing product/service offers, campaign and lottery invitations, studies, questionnaires, surveys, vouchers and/or gift certificates for name days, sent by email, SMS and/or telephone, primarily to improve your experience on bychoice.ro.
• to carry out analyses and reports concerning the operation of bychoice.ro, and create consumer preference profiles, primarily to improve your experience on bychoice.ro.

III.2. If you are a visitor to bychoice.ro, ByChoice processes your personal data as follows:

• for marketing activities, including commercial communications sent by remote means, such as email, about the products and services offered by ByChoice, through bychoice.ro.
• to resolve complaints, monitor traffic and improve your experience on bychoice.ro.

III.3. If you are a contact person for Partners or potential Partners, ByChoice processes your personal data as follows:

• to initiate or perform the contractual relationship between ByChoice and Partners or potential Partners
• for the other purposes and legal bases listed in section III.2 above.

IV. How long we process your data

As a principle, ByChoice will process your personal data for as long as necessary to fulfil the purposes stated above.

If you are a customer, we will process your data throughout the contractual relationship and subsequently according to the internal policies of ByChoice, for the period necessary to fulfil the legal obligations of ByChoice (for example, financial and accounting supporting documents must be retained for 10 years from the end of the financial year in which they were prepared).

If you are a customer and choose to delete your user account by pressing Delete account in the My account information section, ByChoice will interpret this as your choice to unsubscribe from commercial communications about products and services offered through bychoice.ro. If you delete your account, we will stop sending these emails. Deleting an account does not automatically delete your personal data. To object to processing or request erasure, exercise the rights in section VII below. If your account has an active order, deletion can only be registered after delivery and completion of the last active order.

If you withdraw consent to processing for marketing purposes, ByChoice will stop processing your personal data for this purpose, without affecting processing carried out by ByChoice based on consent given before its withdrawal.

If you are a contact person for Partners or potential Partners of ByChoice, your personal data will be processed as needed to conclude and perform the contract, then according to internal policies and legal obligations, including archiving requirements.

V. Disclosure of personal data

To fulfil the purposes of processing, ByChoice may disclose your data to Partners, affiliated companies of ByChoice, third parties or entities supporting ByChoice in providing services through bychoice.ro (for example, couriers and IT service providers), or central/local public authorities, in cases including:

• to administer bychoice.ro, including facilitating your relationship with Partners selling products through this website, if you order products from them;
• where disclosure is needed to award prizes or other customer benefits from promotional campaigns organised by ByChoice through bychoice.ro;
• to maintain, personalise and improve bychoice.ro and the services it provides;
• to analyse data, test and research, monitor usage and activity trends, develop security features and authenticate users;
• to send commercial marketing communications within legal conditions and limits;
• where disclosure of personal data is required by law, etc.

For processing carried out by Partners you interact with under the Terms and Conditions through bychoice.ro , who process your data in their own name as data controllers, please consult those Partners' privacy policies. ByChoice has no control over how they process your data.

VI. Transfer of personal data

Personal data provided to ByChoice may be transferred outside Romania, but only to European Union countries.

VII. Your rights

In connection with this processing, you may request access to, rectification or deletion of your personal data, restriction of processing, object within legal conditions and limits, and exercise your right to data portability. If you give consent, you may withdraw it at any time, without affecting processing carried out by ByChoice based on consent before withdrawal. You also have the right to lodge complaints with the Romanian National Supervisory Authority for Personal Data Processing.
